Just you wait and see, the animals' attorneys, in a Johnny Cochrane wannabe manner, will make the survivor out to be some sort of slut in order to deflect from the fact that their client gave this to her. No punishment is too cruel and unusual for these animals.

Not to put too fine a point on it, but samples of the disease causing agent (virus or bacterium) could be taken and cultured from both victim and attacker, then the DNA compared. If it's the exact same pathogen, then there will be strong reason to believe he gave it to her...
