Rightly or wrongly, courts tend to frown upon such actions.

Unfortunately, you are right. I kept reading, to see where they had arrested the home owner for defending his property with a little too much zeal. He was not, but I am sure the criminals will sue him, and win. They will own his house later, so he may as well let them steal whatever they want now. What a world we live in, where a criminal can take a victim to court, and win. Kind of sucks, doesn't it?

Mr. Schwin should have had the safety off, and started opening fire a la Denzel Washington in Training Day. Both perps should be dead.

Sue him? Where's the damage? What harm have they suffered? They have no basis for any claim whatsoever.

Here in New York, one of the most felon-friendly states, the attitude of the local police is the critical factor. If your actions land you in court, you'll almost certainly be convicted of daring to wield force in defense of your person and property. The penalties can be severe. However, if the police who're first to the scene personally approve of you and of what you did, they'll help you arrange the business to make it look as if you had no choice -- that you were in a kill-or-be-killed situation.

Obviously, this isn't good news for persons who believe in their rights of self-defense. Or for fans of the rule of law.

Criminals who have given up their lives of crime to feed the fishes full time don't sue anybody.
