A reporter on the scene was asked about that. She said she could see how it was possible that the shooter did not see the trooper.

This guy had to see that Trooper across the street when he was sighting the victim......and took the shot anyway..

I don't know if he had to see the Trooper. I think it more likely if he had, he would have driven away before shooting.
