Can't Bush appoint these judges while Congress is out of session? Didn't Clinton do that?

Yes, he can. It is called recess appointment. And yes, Clinton did it often.

Yes but the appointments must still be confirmed or they last only through the end of the 107th Congress. So effectively they would be out come Jan 3, 2003 or whenever it is the 108th is convened.
