That's right. Try to let it slide. (Tfh on) There was no way the SC would take jurisdiction. No constitutional question involved. Can't deny voters right to vote.

Even if Lautenberg is beat at the polls, this is still a loss. SCOTUS has said, loudly and clearly, that state courts can rewrite laws and usurp Constitutional authorities on a whim.

There is another way!

If the Republicans can obtain 51 Seante seats through the election, they can refuse to seat Lautenberg on the basis he is an illegal candidate. The Senate has a Constitutional prerogative to determine its own membership. NO court can intervene.

Some may argue that that they only need 50 seats (because the Vice President would break a 50-50 tie), but I recall an arcane Senate rule that requires a majority to organize. Anyway, some RINO could always do something like Jumpin Jim Jeffords did, so the bigger the majority, the better.

Problem is, this is about more than just this race. As others have said, the Dems will be quite eager and willing to try pulling this frequently.

That said, please remember that there is no SCOTUS ruling that says "this is okay." They merely refused to review it. Who knows what their reasoning was; they typically don't say.
