Makes my point, really. Claim to cite Miller and just make a decision out of whole cloth that has nothing to do with the cited case.

And IMO the SCONJ doesn't even have the equivalent of Miller to cite here - they have one case where the guy died and the NJ courts allowed someone else on the ballot. Toricelli can still legally take the Senate seat if he were elected. We'll have to see what SCONJ values more - it's reputation or its political affiliation.

Well, your opinion is well thought out IMHO

Hey, maybe that is their out. "...and since the Candidate died in the polls we find that... blah, blah, blah...."
