New Jersey Case Cite RE: What the Democrats Are Trying to Do

New Jersey law already has precedent for such an issue. In Tomasin v. Quinn, 376 A.2d 233 ( N.J. Superior Court, Law Division, 1977), a candidate for county sheriff withdrew, and another man wanted to take his place on the ballot. The court refused.

Your case would not be on point if it involved Republicans. The New Jersy Supreme Court is simply going to ask the State Democratic Committee what it wants and that's how they'll rule. You think Torrecelli is the only one in Jersey who is a crook?

I "googled" this case, and found it among these cases:
Party Switching in NJ--Riecker v. Hartman/supp 22. The court held that without an explicit statutory restriction, and since there are precedents that election laws are to be construed liberally so as to effectuate enfranchisement, a candidate who lost the Republican nomination in the primary, but won the Democratic primary through write-in votes could be placed on the general election ballot in November.
Ballot Position--Tomasin v. Quinn/supp 39. The court denied an application to transfer the position of names on a primary election ballot because the county clerk's discretion to do so was limited by statute which require transfers to take place in a certain manner and time.
Ballot Name--McManus v. Allan/43. The court denied a request to permit the use of another person's name on the ballot for the purposes of party affiliation without the consent of the person as required under NJSA § 19:23-25.
