That was different. The balance of power in the Senate wasn't at stake. Nor was a woman's right to choose, or our right to clean air, or seniors ability to get RXdrugs, etc etc etc blah blah blah

I'm listening to Bill Press right this minute, saying "The only difference in 2000 and now is that in 2000 the GOP was trying to stop the COUNTING of votes, and now here in 2002 they are trying to STOP the voting.

It was a sickening surreal feeling in 2000, and it's the same now. These people are sick. They really are. When Nixon was forced to resign, did Republican's say the Dems were trying to "undo the results of an election?" I mean, the sheer nerve. It's sick, sick, sick.

I am assuming that the minor party candidates will be given an opportunity to join appropriate legal action. They are hurt by this stunt, as well.

Beyond the immediate hurdle, the only way to stop this continued nonsense by the RATS - litigating every election -- is to punish every RAT nationwide -- federal, state and local. Do not split your tickets. The alternative is that the RATS become more daring, more egregious with every election, aided and abetted by the news media and a dumbed-down electorate. Help stop this now.

Well I guess if they voted for Toricelli, then they're vote won't count.

I hope Forrester uses this argument. But I do not think the court will care... and the court won't care about precedents in caselaw either.

Maybe it would be a good time to start praying. Its just blatant unjustice.

Well what do you do in my case. In AZ our supt of public instruction who won the primary switched parties from Dem to Rep just to run in the Rep primary knowing he'd win the seat. If there is a third party candidate for that office I will vote third party.

Ballot Position--Tomasin v. Quinn/supp 39. The court denied an application to transfer the position of names on a primary election ballot because the county clerk's discretion to do so was limited by statute which require transfers to take place in a certain manner and time.

That was the main case the court decided in this opinion, but, as dog says, the opinion also involved a candidate who was approved by the party concerned's Committee of Vacancies after the original candidate had pulled out of the primary. The court held the new candidate could not be put on the primary ballot (for Sheriff of Hudson County) because the (then 34-day) deadline had already passed:

Similarly, N.J.S.A. 19:23-12 bars the substitution of Dominick J. Pugliese on the ballot in place of Frederick W. Stevens for the office of Sheriff of Hudson County. It is conceded that candidate Stevens withdrew his candidacy for this office within the past few days. The Committee on Vacancies has put forth Mr. Pugliese as a candidate for this office and seeks to have his name placed on the ballot. This is clearly in violation of N.J.S.A. 19:23-12 since the 34-day time period has lapsed. Accordingly, the application to substitute the name of Dominick J. Pugliese for Frederick W. Stevens for the office of Sheriff of Hudson County on the primary ballot for the forthcoming election is denied. 376 A.2d 233, 235.

The opinion does not say what the party involved was, but, since we're talking about Hudson County, it was presumably Dems.

Well at this point I wouldn't put anything past them. Even by taking this to court, they've already proven they are willing to twist and contort any law because they think they are right.

Typical democRat swill. They are the ones who created this situation and now they are going to try to use it against us. I give you credit for listening. I'm at the point where I absolutely have to immediately click off Press and Begala. After what went down in the Democratic primary down in Florida, and now this, one can only imagine what sort of sleezy underhanded plot they have in store for Jeb in November.
