New Jersey law already has precedent for such an issue. In Tomasin v. Quinn, 376 A.2d 233 ( N.J. Superior Court, Law Division, 1977), a candidate for county sheriff withdrew, and another man wanted to take his place on the ballot. The court refused.

I think the Court will allow it; otherwise they would have refused to hear it.

I'd love to be a fly on the wall in Supreme Court Justice Scalia's office right now...

It's so discouraging, isn't it? As I said earlier, the phrase "right in front of our eyes" keeps going through my mind.

What reason, other than politics, could the NJSC have to allow this law to be completely set aside???

The only reason given for this request is partisan, so that the Dems have a chance to win. If this is allowed, election laws will carry the same weight as UN resolutions. They won't be worth the paper on which they are written.

Oh I'm sure the Dem-heavy SCONJ will find a loophole. You know, there are ALWAYS loopholes... well, at least when Dems are involved.

When it comes to the control of the US senate I don't think they'll care...

What gets me is how the Dems on the Judiciary comm are voting against Bush's nominees because they "appear" to be activists but have no issues with judges who are Dems that are "activists."
