First of all...it is still OUTSIDE the 30-day mark. From the WNBC article earlier, if he resigns the Senate today, then they can run another candidate. But what if the Torch is majorly pissed at how he himself has been treated by the RATS (basically left to drown), and is saying, "Oh, okay, I'll quit ... on October 7th!"?? That would be INSIDE the 30-day mark, and make things much more interesting.

If you are reading this law correctly, then it surely must be unconstitutional. If resignations when down in the polls can get a member of your party appointed for another 1 year or 2 years until a next election, then that could theoretically go on indefinitely.
I personally have no problem with the Torch resigning. He can do that anytime he wishes. If someone else what to run after that announcement, then that's his business. (If I want to start a write-in campaign for myself at this moment, then that's my business and ultimately up to the voters.) The issue is being within the deadline for having a name on the ballot, etc.

The thing that really strikes me is that the Democrats are so willing to "game" the election after hollering that Bush was "politicizing the war."
That is the definition of "no shame."

The thirty-day time limit is for appointing someone to serve the remainder of the term. A separate New Jersey statute prescribes that ballot replacements for general elections must be done 48 days before the election (which has already passed). Forget about the ballot. If Torch resigns from Senate within 30 days of the election, gov can appoint someone to fill the seat until the next election, presumably two years hence. A complete end-run around the ballot box.

Yup, if little Donnie D had had stones and stood up for Schundler we wouldn't be in this pickle right now. It's Donnie D's fault!
Looks like writmeister's settled it. There can be no 6-year replacement for the Torch. The election on Nov 5 must be held, whether Torch is on the ballot or not. End of story. All we have to do now is keep the RATS from illegally dumping another name on there.

It's pretty obvious that the dems are going to try to throw someone in at the last minute who they think wil have a good chance against Forrester. OR, they might try to pull some B.S. utilizing some obscure law that allows the Governor of the state to get involved. Anyone who thinks that this is a last minute development has a lot to learn.It IS a late minute desparation move on the part of the rats. Remember that the Torch was given the job of responding the President's radio address a few days ago. Why would they do that if they were planning on dumping him today?
