We are outside of 30 days. Election day is Nov. 5th. They would have to wait another week (approx.) for the Torch to quit.
My question is: under the current system, wouldn't it be possible to have the same party in the Senate forever and ever. Once your party has the seat, all you have to do is have your candidate drop out of the race a week before election day and appoint another party guy to keep the seat. Of course, to do this, you'd have to have a cooperative governor that wouldn't order a special election.

If the Torch resigns & says that it'll be effective as of the end of the Senate session (end of next week I think), that'd be within the 30 days.

Exactly my point. And it is because it would be an attempt to get beyond the constitutionally mandated 6 year terms, the SCOTUS would not hesitate to strike that down.

Of course, to do this, you'd have to have a cooperative governor that wouldn't order a special election. I believe they do. Remember, Bill and Hill are running the show. They will stop AT NOTHING to keep power.
