How would the citizens of New Jersey feel about being told, "Never mind; we're not going to have an election."

Howlin, resigning does not cancel the election. The statute relates to win an election must be held to fill the remaining balance of an existing term. That is why resignation did not come up. It does no good.

The SCOTUS would have something to say about New Jersey trying to cancel a federal election on the basis of a state law. It would never happen.

Actually, he has until October 6th to resign; I'm hearing conflicting discussions that it has to be by Saturday but someone said no later than Monday and that X42 could set up residence in NJ and make a run for it. Can you imagine? I haven't felt this familiar knot in my stomach since November 2000.

An expert on Britt Hume's show said the NJ courts would undoubtedly rule in our favor and the only time they reversed an election was due to someone's death -- in this case his 'political death' does not apply.

So the first move is for Torch to announce that he is bowing out of the race. Now they have until Oct 6 to see if the courts will allow a replacement to be placed on the ballot. Failing that, Torch resigns from the Senate, the dimo Governor appoints Bradley or Laughtenberg (sp?) and schedules a special election for Nov 2003. Is this the game plan? In any event, it seems to me if Torch bows out then Forrester runs unopposed in Nov 2002. If Gov appoints a successor to Torch, then the succcessor completes the Torch's term (i.e. through Dec 2002). I don't see how the Governor can postpone the election for Federal Senator just because Torch bows out and resigns. Sure the suits are digging in.
