You have asked for an analysis of New Jersey ballot statutes and regulations regarding a possible vacancy in connection with the upcoming election in New Jersey. New Jersey law explicitly provides that when a vacancy occurs among primary nominees, the state committee of a political party committee may select a replacement candidate. N.J. Stat. § 19:13-20. However, this ballot replacement is only allowed when the vacancy occurs more than 51 days prior to the election. Id. Inside of this 51 day statutory window, a replacement candidate can not be put on the ballot. The only exception ever recognized by a New Jersey court was in the case of the death of a nominee. Petition of Koegh-Dwyer, 106 N.J. Super. 567, 256 A.2d 314 (1969), affirmed 54 N.J. 523, 257 A.2d 697. It is worth noting that the time limit was raised from 34 days to 51 days in 1985. Legislative history from the original statute states that time limit was included "to afford election official sufficient time in which to attend mechanics of preparing for general election." Kilmurray v. Gilfert, 10 N.J. 435, 91 A.2d 865 (1952).

Actually, he has until October 6th to resign; I'm hearing conflicting discussions that it has to be by Saturday but someone said no later than Monday and that X42 could set up residence in NJ and make a run for it. Can you imagine? I haven't felt this familiar knot in my stomach since November 2000.

An expert on Britt Hume's show said the NJ courts would undoubtedly rule in our favor and the only time they reversed an election was due to someone's death -- in this case his 'political death' does not apply.

The coverage of this is what's disturbing. Much like the 2000 election, where if the situations were reversed, the Republicans would have had zero chance to take the election. McGreedy and Corzine et al act like this is a fait accompli. Our candidate is getting his ass kicked, so let's find a new and circumvent all election laws.

The media, even FNC, seems reluctant to call a spade, a spade.

That may well be, but he may yet resign (I think he has till Saturday). It's so hard to predict what unprincipled, immoral people will do.

At this point, just talking about what the Democrats were contemplating should be eye-opening for the nation. It doesn't matter if it plays out or not, the nation should be learning a big lesson from the behavior of Democrats over this. When you add the Democrats in Iraq choosing Hussein over Bush, Daschle's meltdown the other day, and Reno in Florida, you get a strong feeling that perhaps our best interests are not being represented.

I dont' know if the 4 is this: but if you're talking about states, Iowa could go to Ganske, the Republican Senate candidate if Harkin's staffer gets immunity and starts talking.

Then, Harkin would be next to resign. But, do they then shut Ganske out in Iowa by using the NJ strategy?

Thanks. I think this makes it clear that the seat is ours although they will try to influence other races by dragging this through the courts, thereby promoting the canard that Pub lawmakers are 'appointed' by courts and not elected by the people.
