I am not even talking about the rightness or wrongness of the death penalty but it's legality. For a judge to declare the federal death penalty unconsitutional is a usurptation of power from the legislative branch. It is CLEARLY constitutional and an outright misuse of judicial power to say otherwise. If you want to get rid of the death penalty then do so through the ballot box or attempt to amend the constitution. Don't corrupt the law with your politics and approve of judicial tyranny.

YOu make a great case for it's repeal on the Federal level. So if you are willing for a judge to overturn a clearly constitutional power of the federal government based on nothing more than his political opinion and not the law why not just dispense with the legislative and executive branches all together and just let our wise judges make, interpret, and enfore all "law"?

Well, you caught me.

It's the reactionary's dilemma. Understanding that the culture war has, in fact, been lost and that conservatism consists primarily of feeble rear-guard retreat maneuvers like "compassionate conservatism" and "safe, legal and rare", what are we left with? An occassional gesture---usually performed by some wild hare in the judiciary branch. I admit that is a terrible thing to rely upon. But it's inevitable, after losing all institutional bases of operation, to go begging at the door of the court house for alms.

In light of the total victory by the ideas and language of the left I cannot, for the life of me, comprehend the wild enthusiasm that people on this forum have for the death penalty. And the FEDERAL death penalty at that! The Federal government is the most powerful domestic enemy that the tattered shreds of conservatism face. I would even argue that our current "foreign foe" has the Federal government's finger prints all over their blood-stained korans.

More so than any State government, the Federal government uses its police power to "send messages"; the message is never more loud and clear than in the death penalty statute. I'm stunned that so many conservatives would willingly support a death penalty that could be interpreted by an Attorney General appointed by Hillary Clinton! Think of Waco Janet to the tenth power!!

Besides, we don't really have a death penalty in this nation--even on the state level. We have an ocassional human sacrifice offered as part of the bread and circuses and to provide activists lawyers with a chance to appear morally superior.

The unwillingness to even consider the relationship between income level and liklihood of being executed is amazing to me---especially since the wealthy people in the country are overwhelmingly post-modern Lefties.

And let's don't even get into the terrifying subject of the relationship between personal beliefs and the likelihood of being targeted by the "Forces of Freedom" in Washington DC.

But, you are correct that cheering an activist broken clock for being right twice a day is a very dangerous hobby. Sadly, It's the only one left to us reactionaries....

It has no affect on state death penalties. Who cares?

Who cares?-- what about federal crimes like international terrorism? These type cases are heard in Federal Courts-- not in state courts.

This is an honest question: How many times has someone received the Federal death penalty in the last, say, 50 years? I mean, you are right, I was wrong. It is important. I shouldn't blow it off. It just seems that 99% of the death penalties come from the states.

The Texas Judge William S. Sessions was a former FBI director fired by president william jefferson clinton!

This VT judge is william k sessions iii.
