Uh huh...I was expecting that one. Funny how that doesn't seem to fly when people are accused of anti-gay bias (such as Dr. Laura) It was used in the case of another supposed do-gooder with the AIDS virus (bold and color type mine):

Posted on 10/27/2000 01:59:56 PDT by L.N. SmitheeA San Rafael man who is infected with the virus that causes AIDS was sentenced to two years in the Marin County Jail yesterday for having unprotected sex with a 15-year-old boy, potentially exposing the youth to the HIV virus.
John Zukaitis, a longtime AIDS activist in Marin, sobbed as deputies placed him in handcuffs and led him to the jail, despite pleas from his attorney to allow him to surrender at a later date.
Marin Superior Court Judge James Ritchie ordered Zukaitis to begin serving time immediately, though he spared him a state-prison sentence as a way to acknowledge the positive work Zukaitis has done in helping others sickened by the virus.
Ritchie said letters from the defendants' supporters convinced him Zukaitis "has accomplished quite a bit of good in his life in addition to this conduct, which was quite bad.''
Zukaitis pleaded guilty in August to sodomy, oral copulation and two counts of lewd acts with a minor after Ritchie agreed not to send him to prison. The judge said he was interested in concluding the case and sparing the boy the ordeal of having to testify.
The prosecutor in the case, Kathryn Mitchell of the Marin district attorney's office, said she favored a prison sentence, though she told Ritchie that the young victim and his father felt confinement in the jail was appropriate punishment.
The defendant's attorney, Glenda Brewer of the Marin public defender's office, said Zukaitis had otherwise lived an "exemplary life,'' and that his offense was "the one thing that he has done in his life that could be considered a crime.'' The youth did not attend yesterday's sentencing hearing.
Zukaitis, 37, was arrested in April by San Rafael police. The teen, a Santa Rosa resident, told police he and Zukaitis became acquainted last summer via an Internet chat room and later met at Zukaitis' apartment in San Rafael's Gerstle Park area.
The youth testified in court earlier this year that Zukaitis showed him a pornographic movie and sodomized him over his protests.
The boy also told investigators that Zukaitis did not wear a condom.
Ritchie said yesterday that the youth has been tested and there is no indication he contracted the AIDS virus. Brewer asked Ritchie to spare Zukaitis a trip to prison and requested that he leave it up to county probation officials to decide whether Zukaitis was eligible for a parole program that would allow him to serve his time under house arrest, while wearing an electronic monitoring device.
But after hearing Mitchell's objections to house arrest, Ritchie ruled Zukaitis ineligible for the county parole program.
With time off for good behavior, Zukaitis' stay in the jail could be reduced by nearly half, Mitchell said.
In addition to serving jail time, Zukaitis will have to register as a sex offender in the communities where he resides for the rest of his life.
Ritchie said Zukaitis will be placed on probation for at least five years, and warned that violations of his probation terms could leave him exposed to the maximum possible sentence for his crimes - nine years and eight months in state prison.
