Ending a weeklong search, a mother who was caught on film allegedly punching, shaking and slapping her daughter in a parking lot turned herself in to authorities Saturday.
Madelyne Gorman Toogood, 26, arrived at a police station late Saturday afternoon after meeting police with her lawyer, Steven Rosen, at an undisclosed location, according to Lt. Jeff Giannuzzi.
"It was a bad choice, and it was captured on Candid Camera," said Rosen Friday. "She's very remorseful. She regrets it."
The daughter, 4, was being examined in a hospital, prosecutor Chris Toth said. She was with her father, Johnny Toogood, grandparents and other relatives.
"She's safe. We just have to, at this point, make sure there are not any deeper physical injuries," Toth said. "She's a sweet, wonderful girl. Physically she looks fine."
An arrest warrant issued Friday charged Toogood with battery to a child, which carries a maximum penalty of three years in prison. Earlier a judge set her bond at $5,000, although prosecutors had requested a $50,000 bond because of her transient history, Toth said.
Toogood, who investigators said cooperated during a one-hour interview, was transferred to the county jail for booking, Toth said. She posted bond and was released Saturday night, decling to talk with reporters gathered outside the jail.
Before Toogood surrendered, Rosen said her extended family members and friends told him the child was fine and had been examined by a doctor. "The child was examined, and the child was mentally and physically stable," he said.
The girl was with her mother Friday night, and the woman's two sons, ages 5 and 6, were in "good, safe hands," Rosen said in Saturday's Chicago Sun-Times.
Rosen said Toogood grew up as part of a group of Texas-based Irish Travellers, itinerant laborers who often make their living with home-improvement and business-repair work, such as paving, painting and roofing.
Mishawaka authorities said they had no indication Toogood has ever been accused of abuse. However, they said she did have a history of retail store fraud.
The Fort Worth Star-Telegram reported Saturday an arrest warrant was issued for Gorman on April 9 after she failed to pay a $202 traffic ticket for having no driver's license.
In May, Fort Worth police issued another warrant for Gorman's arrest after she failed to appear in court to face theft charges stemming from an alleged March 27 shoplifting incident at a Kohl's store there.
In the Indiana department store video, Gorman is seen placing her daughter onto the back seat of a sport utility vehicle in the store's parking lot, then pummeling, slapping and shaking the girl for several seconds.
The episode happened after the woman left the store angry over being refused a cash refund, authorities said.
Toogood's sister, 31-year-old Margaret Daley, who authorities say was with her at the store, was arrested and charged with a misdemeanor count of failure to report child abuse. Prosecutors later added a charge of assisting a criminal. Daley was released Friday after posting $2,150 bond.
Police received more than 1,000 calls about the video, which was first aired Wednesday night by local stations seeking the identity of the woman and girl.

Look, you can play posting games all you want. Any sober, reasonable person who sees this videotape will conclude there's a serious problem with the treatment of the child. As for no visible signs of injuries, we all know children are very resilient. She disappeared for a week and that's plenty of time for a bruise to heal.

Sorry, but one is presumed innocent until proven guilty. The word you left out is important because it states the "legal requirement" for conducting a criminal trial. Since we are not jrors in a trial we are free to believe the women guilty based on the video which is very compelling.
As to the other point, you wouldn't have seen anyting if you were walking by, The video shows the women look around to make sure there were no witnesses (so she thought) before whacking the kid.
