the child has a basic right to get educated

You are walking on dangerous ground here. If a child has a right to be educated who infringes on that right when they are failed? Would you have the Child Protection Services take a child out a home when the child was in the 8th grade and could not read despite being public school all his life because his parents should have seen that he was educated? Would you allow parents to sue school districts for infringing on their child's right to an education when their child fails a grade? Not for not promoting him, but for not educating him in the first place. It is very slippery to say that one has a right to anything if you are not willing to punish people for taking it away.

Sparky, As long as the state enforces compulsory attendance, and extorts tax dollars, they should be lawsuit liable, for failure to perform their end of their mandatory contract.
