Had the child pornography come from spam e-mail, etc., as you suggested, it would have been presented as evidence by the defense. There is a way to show how the pornography was loaded and it wasn't loaded onto his computer innocently through any of the methods you suggested. Go read the trial transcripts pertaining to this matter and you will see that your suggestion is wishful thinking on your part.
