Yup. Someone should challenge the constitutionality of the N.C law, not in respect to obscenity, but to cruel and unusual punishment for what basically no one would consider a violent offense. Now if the porn were viewable by children nearby, I'd say throw the book at em but in the circumstances that were reported all they were doing was watching a movie in their SUV. Its hard to imagine the cops busting them for watching an R-rated movie.

Isn't this a SCOTUS-approved example of obscenity being defined by "community standards?" If you don't like it, don't live there.

I'm not gonna tell people in NC to do anything... it's their community, and their standards.
But I've got a teenage daughter, and I'm not interested in allowing guys with arrested development to be shuttling from neighborhood to neighborhood with porn running in their SUVs.
That's playing with matches and gasoline simultaneously.
