Sure about what? I am sure that NIH is under HHS, but I am not completely sure whether CIA and the Postal Service are the only independent agencies of the federal govt. Who knows, maybe Bush has added another forty in the past two years?

NIH is not an independent agency. It is an agency under HHS. Well, you do appear to be correct on both counts in this regard, but probably only by coincidence, given your total disregard on this thread for factual information. However, it is still clear, however, that NIH does have some independent authority not directly subject to the Secretary's control, as outlined by the 1993 act.
