Kessler largely limited her ruling to the government's obligations under the federal Freedom of Information Act. NOT the VIth Amendment. This is a BS ruling by a liberal freak judge.

She ruled based on the freaking Freedom of Information Act, not the U.S. Constitution, according to the news articles I've read. I will need to read the ruling to verify, but based on the news accounts of her "reasoning", it's a ludicrous ruling.

No, this was about workers who wished to have the portion of union dues that is used for political activity refunded to them. The unions sued, got it in front of her, and she tossed the order.

I have been reading your posts on this matter and concluded that I disagree and think you just stretch to compromise the interest of the US, but further conclude that it is your right. This post makes me think you are just plain dumb. Anyone that would ask the question How can having the government admit that they’ve arrested someone “tip off” anyone? must be joking or just plain naive. I refuse to believe that you could be so stupid, regardless of your left leaning, to truely find this proposition so puzzling. Maybe this is the reason why the left is so f****d up in their common sense.

I get so confused hanging out at FreeRepublic. Those of you who assert some right of the government to operate in secret are too trusting. You forget it may be you next. We'd hear squealing them, I am sure. This judge made the right decision. The government has no business operating in the United States as a spook entity. Period.

I have just skimmed this "judge"'s ruling, and it is indeed a Freedom of Information Act (FOIA) case, NOT a Sixth Amendment case. The judge does not deem the names of the detainees to fall within any exemption to the FOIA. I am quite confident she will be overturned and bitch-slapped. She needs to be removed from the bench.

You haven’t read the Patriot Act, tomahawk.

Anybody can be classified as a “terrorist,” on nothing more than the word of a government agent. On suspicion, not proof, not even evidence. Anyone can be arrested secretly, even if that person is a citizen, even if that person isn’t an Arab.

Tell me, tomahawk, was Bill Clinton’s actions something you consider legal? If not, the fact that he got away with his actions, and is even honored by our President Bush, is evidence that we do not live in a nation ruled by law. A nation not ruled by law is a tyranny.

Secret arrests, secret prisons, and secret executions would also be evidence of a tyranny.

Citizens organized by their government to spy on their neighbors would be evidence of tyranny.

That's enough for now.

And no, I will not "exodus" my nation. I wouldn't leave if my home was broken into, either. I'll stay and help the invader on his way.

You misunderstand me at least. The releasing of names will impeded current investigations.

The SaudiIslamic Lobby, their Fronts in the US, like CAIR, AMC etc will jump on this chance to sue the government.

BTW, Everything's about money.

You're right, Exodus, I haven't read the Patriot Act, and I should. I basically trust Bush and Ashcroft and know they are not out to turn this nation into a tyranny. But since the law will be around after they leave, I should become familiar with it, and it can be (and is being) challenged in court. I also know Kessler is a liberal freak judge and she ruled in this case under the Freedom of Information Act, not any U.S. Constitutional claim.
