Perhaps something similar is going on here.....
Anyway, all the government has to do now is move all these detainess on whose behalf the suit was brought to a different state or maybe even Guam or someplace else.

Thanks. I thought I was the only one who noticed. It's stunning how much we're desperate to give away even though this "war" we're in rarely is even newsworthy... other than to mention the latest new way we can "give the authorities the power to ____" with total impunity. 5 Americans were murdered in Israel yesterday by terrorists. 5 soldiers were wounded, two seriously, by terrorists in an ambush 3 days ago. Is that newsworthy?

Examine your own head. We are in a war. Sh!t happens in war. The reason that more hasn't already happened in this war on this soil is because these people have been detained. It would be the height of irresponsibility for the government to let these people go. There's a huge difference between releasing their names, and releasing their bodies.
(Hmmm, releasing the bodies... that has a nice lethal ring to it, doesn't it? hehe.)
If they are a threat, then treat them accordingly... but not behind a curtain of secrecy. Can you imagine how many people will disappear into remote Nevada jails when Hillary is President if this is bad policy is allowed to stand?

You are overly concerned about detaining these folks. First off, all of them are foreigners. They are being detained in the same manner foreigners are detained all over the world - as you would be, in fact, in France, Spain, Germany, UK, Canada - if you were not a citizen, had no right of residency, and were otherwise breaking the law, particularly the immigration laws.

I thought there was nothing anyone could do about an Exective Order, execept a new President.

Well said. I'm astounded by how many FREEPers here are siding with this recent Clinton appointee judge, a know very left lady. She only got on the bench because she claimed to be this big woman's rights activist for the Women's Law Center. Speaking as a lawyer and a female one at that, the best thing they could do for women's right is put *SMART* judges on the bench. This ruling is not smart.
Well, take it from a compentent lawyer: DOJ *will* appeal to the D.C. Circuit and they will reserve this judge.
For any of the would-be lawyers out there who think this judge is right, note this: the law and the constitution is quite clear on the executive's perogatives in war time. This isn't a constitutional issue. She ruled strictly on FOIA. I read the ruling. It's this ridiculous, hand-waving emotional quote on the importance of openness. FOIA has well-established exceptions for disclosure that include this situation.
Let it be said many times: the Bush White House has done more for women by hiring on *TALENT,* like C. Rice. Clinton administration hired on as judges friends of Hilary Clinton's feminist network. Not the smartest bunch.
I know for a fact that Judge Kessler's already been involved in a lot of liberal intrigue on this federal district court. Ridiculous. God Bless the United States, and actually God Bless the federal judiciary, which have plenty of judges that *do* respect their constitutional role and aren't out to make a public demonstration of themselves and a big news splash just to feel the rush of power. May the D.C. Court of Appeals rule quickly, and God guide their deliberations.

What these well meaning people do not understand that these are not criminals...they are ideological warriors (not religious, IMO, but that's another thread)...None of the September Eleventh Attackers had any criminal records apart from Atta's traffic violations and non-appearance on some traffic court charge.
In a war of shadows, we cannot allow the enemy to use our freedoms and civil liberties against us.
This is intrigue, espionage, skullduggery and probably some buggery thrown in. It's dirty, messy and much like watching laws and sausages being made, Which very few have the desire or stomach for.
Literally every day, new arrests are being made demonstrating to us the extensiveness of the conspiracies arrayed against all of the nonmuslim world.
How many others with nefarious designs are still running free out there......
Personally, i hate roadblocks to catch drunks and seatbelt scofflaws, but ones to ask me for my passport would not phase me one bit, it would show we are serious about this war, that BTW, is VERY newsworthy. It's just our blowdried fluffbrains on TV deem it necessary not to inform us about.
How many stories posted here should be shown and discussed on the evening news and talk shows. How many actually are?

Next plane that comes crashing into the DC area, I want it to take out a courthouse, and hopefully Judge Kessler.
No doubt it will take something like that for YOU PEOPLE to figure out we have been invaded by a foreign army and are under attack.
We have a fundamental right to self-defense, and people like you and Kessler should just get out if you don't agree. Go to Canada or some other place where they don't care!

Read the Court of Appeals ruling that will be coming out later reversing her. I've dealt with FOIA before, and the Govt. usually gets away with keeping information about active investigations secret.

My point is that the administration is stretching absolutely every single "wartime" authority, power, and Liberty-grab (and creating a few new ones), and yet this has been the least fought war in ages. The juxtaposition is concerning.
BTW, in every war ever fought (okay, before Desert Storm), a grand total of 5 casualties for a day would have been great news. However, I did rail at the TV screen as President Bush disregarded these murders of American citizens in favor of continuing to try to make "peace" with those who want to see us all dead.
