That was a civil suit. In any event, the "can't" bit was just a conclusion. I don't think it was grounded in anything.

The discussion was whether high crimes and misdemeanors meant asking people to commit perjury. He was never close to impeachment until that story broke.
I'm positive it has to be high crimes while in office.

I don't think it's grounded in anything either; that seems to be the problem, from all that I've read. Gerald Ford said high crimes were whatever the House said it was, but then they ended up deciding that some financial doings that Nixon was accused of -- what was it? -- didn't rise to high crimes.......but it WAS while he was running for his second term.......it may have been something concerning CREEP.
