A civil lawsuit can be based on wrongdoing which is also a crime, such as fraud. Ther standard of proof and even the elements of the wrongful act differ, however.

Someone can steal from you and you can sue to recover your property. OJ murdered two people, and got off on the criminal side, but the families sued him in civil court and won. It's called "wrongful death" in civil court, not murder.
