What's with that?? The prosecution put Johnny Keene (love that name!) on the stand, and he could testify to everything DW told him...

But when it comes to the pizza partiers, the LE interviewers can't testify??

Doesn't make sense to me either...both are statements.

I think the person has to be there to be able to rebut....as DW is in court???

I am just getting caught up, but a statement by a party is not hearsay. Likewise, a prior statement by a witness is not hearsay. So, the prosecution can introduce prior statements from DW. If a witness testifies to what they said, the defense can call a witness to refute that testimony.
