"The lynch mob theory"
Posted by jameson on Jul-05-02 at 08:45 AM (EST)
as i see it, of course with commentary

DW leaves Dads cafe, at sometime between 10:30 and midnight. He is sexually frustrated because he didn't get any attention from Brenda (who isn't his type - too heavy) or Barbara or Denise. But he doesn't go to another bar or the streets for another chance to get laid (he could have paid for it)- - no, he is angry and determined to take it out on a 7 year old child who sold him Girl Scout cookies the week before.

Damon, ever helpful, has tucked the kids in bed and retired to his room with the big dog, shuts the door and turns on the TV.

So DW sneaks into the van Dam home through the unlocked garage door. He shut the door behind him or look to see if he has tripped any alarm. Nope, just goes in the garage and leaves that door open.

Now, what time was this? Probably before the 1:30 dog potty dance because after that we have Damon in his room with the door open waiting for Brenda and her friends to come home. Not asleep, awake.(Damon took the dog from his room and missed the blinking red light on the burglar alarm? Didn't have any idea anyone was in the house and the dog went right out to attend to his business, didn't seem interested in any strange smells in the house.)

According to the persecutors, DW found himself unable to just grab the child and leave - - either Damon got up with the dog or Brenda came home - so we have the break-in somewhere between 1 and 2. DW would know Brenda would be home any time - - but - - well, with that testosterone rush, he just didn't care.

I see no way he hid in Danielle's closet - too full according to the crime scene photos - so he either remained in the garage with that open door or just stood in Danielle's room and didn't drop a single hair or leave a single print or fiber. He pretended he was the Tin Man.

He had to hear the people in the house - busy house. Finally it is quiet and he grabs
Danielle. She puts up NO fight and the 220 pound man silently takes the 60 pound child out the sliding glass door into the backyard - the door furthest from his own house. (This despite the fact that the front door is pretty hidden from the road and would have been just as safe as exiting the gate On the side.)

It is very cold but she doesn't wake or cry out. DW is very lucky.

He takes her to his house, no one sees him - not even Mrs. Kravitz who can't sleep and looks out windows. (I know she couldn't see the front of the van Dam house - but if DW can look out his bathroom that faces the REAR of his house, faces the Hoeff house, and he can see in a backyard across the street and two doors away to the left, then she should have been able to see DW carrying that child across Briarleaf. The views in SD are different from in Kansas.)

He took her upstairs and put her in his bed - - she lost a hair - but she didn't leave any fibers from her pajamas so apparently they were off by then. Still, he didn't assault her there - no blood. He didn't let her touch anything, no prints. She wasn't bound or gagged, just obedient.

He waited until 8 in the morning, trusting the family would sleep until noon, I guess. Then put her in the SUV where she did NOT lose any hair or leave any prints and took her to the RV.

Then the drive back to Sabre Swings. Maybe he thought he could sneak her back into her bed? Aw.... cop cars, may as well go camping with her. Stock the RV, fill it with water....

Drives to the Strand, couldn't find what he wanted on TV and wanted his PDA (maybe there were instructions in the PDA - - how to dump a body?) So back home.
Cops still there. The cops don't approach him so he talks to his neighbor, checks his pool, leaves his card, gets back in the motor home and takes off for Glamis.

Now, stuck in Glamis he is - - the witnesses have two people. One DW has the drapes open and chats
it up with a bunch of people, any of whom might have at anytime said, hey is it all right if I check out your motor home? Those people have photos that show the drapes open.
The other DW had the RV closed up and was strange, he mumbled to himself (after being told the tow was $150.00, I would mumble too) and didn't remember his leveling boards.
(Dan Conklin liked being a witness - - he gave several interviews to media before being gagged.)

At some point in all this, the prosecution claims he killed Danielle - he didn't ever tie her up - no bruises on her wrists. He didn't beat her about the face (no bruises there) - he might have pulled out her teeth - - but she never fought him - - she never clawed him or fought him enough to get any damage to her hands.

Then, according to prosecutors, DW took that 35 foot motor home to Dehesa, pulls over and leaves her naked body under an oak tree. He does this without picking up any shrubs, dirt, etc., from Dehesa, and without leaving any evidence of himself with the body.

Finally, DW went home and let the cops search his house, bring dogs in the RV and they didn't pick up her scent - - luck again!

He goes in for hours and hours of interrogation with space heaters on and people denying him access to water, a phone...

He doesn't confess....
They have no evidence putting him in Danielle's house
They have no evidence he is a violent person
they have no evidence he hurt that child
They have no evidence Danielle was with DW that weekend.
They can't put DW at the Dehesa site

Yep - - that's the case.

Ready to execute DW for that story?

PLEASE, come buy my oceanfront property at the foothills of the Appalachian Mountains.

Where have prosecutors said that DW found himself trapped? I didn't read that in the opening statement at least.. Do you know?

"I see no way he hid in Danielle's closet -" agree

Judging from what little we know, one would expect the house to have been quiet at somepoint afte rthe kids went in bed. This theory is he snuck in BEFORE 10pm? Doesn't seem too likely..but I suppose anything is possible. We don't know if she didn't put up a fight..may she was gagged or something..and that's why her teeth got knocked loose and DVD, after a few beers could have been snoozing deeply cuz of it. Drunks tend to sleep deeper..

It's very possible no one saw him carry her.

He may not have taken her to the master bedroom..he could have carried her hairs himself...

I have to go for awhile..will check in later.

Do you know why no one can find DW's prints in the VD house? Because he wasn't there.

Do you know why we can't ALL figure out how Danielle was abducted and taken without a trace from her own bed?

Because it never happened.

Do you know why Damon and Brenda said the dog didn't bark (when it in fact could)?

Because it had no reason to bark on that night. ..

Just keep asking the questions "Why?" and it all points back to the obvious answer.

The Van Dams are covering something up.

Sometimes, a cigar is just a cigar...Look at the statistics.

the 220 pound man silently takes the 60 pound child out the sliding glass door

Note: he's gotten into the house, and the alarm hasn't gone off. You could chalk that up to the "lady" of the house not being home yet, and the alarm not being set.

But how could he be sure that the alarm wouldn't go off on his way out?? How would he know that it was a silent alarm (lights only, wasn't it?), and not a silent alarm with a connection to the local police/security company? I doubt very much he was fiddling with magnets while he had Danielle over his shoulder.
