Everyone Is Outraged

Arthur Levitt, Bill Clinton's choice to head the Securities and Exchange Commission, crusaded for better policing of corporate accounting — though he was often stymied by the power of lobbyists. George W. Bush replaced him with Harvey Pitt, who promised a "kinder and gentler" S.E.C. Even after Enron, the Bush administration steadfastly opposed any significant accounting reforms. For example, it rejected calls from the likes of Warren Buffett to require deduction of the cost of executive stock options from reported profits.

But Mr. Bush and Mr. Pitt say they are outraged about WorldCom.

Representative Michael Oxley, the Republican chairman of the House Financial Services Committee, played a key role in passing a 1995 law (over Mr. Clinton's veto) that, by blocking investor lawsuits, may have opened the door for a wave of corporate crime. More recently, when Merrill Lynch admitted having pushed stocks that its analysts privately considered worthless, Mr. Oxley was furious — not because the company had misled investors, but because it had agreed to pay a fine, possibly setting a precedent. But he also says he is outraged about WorldCom.

Might this sudden outbreak of moral clarity have something to do with polls showing mounting public dismay over crooked corporations?

Still, even a poll-induced epiphany is welcome. But it probably isn't genuine. As the Web site dailyenron.com put it, last week "the foxes assured Americans that they are hot on the trail of those missing chickens."

The president's supposed anger was particularly hard to take seriously. As Chuck Lewis of the nonpartisan Center for Public Integrity delicately put it, Mr. Bush "has more familiarity with troubled energy companies and accounting irregularities than probably any previous chief executive." Mr. Lewis was referring to the saga of Harken Energy, which now truly deserves a public airing.

My last column, describing techniques of corporate fraud, omitted one method also favored by Enron: the fictitious asset sale. Returning to the ice-cream store, what you do is sell your old delivery van to XYZ Corporation for an outlandish price, and claim the capital gain as a profit. But the transaction is a sham: XYZ Corporation is actually you under another name. Before investors figure this out, however, you can sell a lot of stock at artificially high prices.

Now to the story of Harken Energy, as reported in The Wall Street Journal on March 4. In 1989 Mr. Bush was on the board of directors and audit committee of Harken. He acquired that position, along with a lot of company stock, when Harken paid $2 million for Spectrum 7, a tiny, money-losing energy company with large debts of which Mr. Bush was C.E.O. Explaining what it was buying, Harken's founder said, "His name was George Bush."

Unfortunately, Harken was also losing money hand over fist. But in 1989 the company managed to hide most of those losses with the profits it reported from selling a subsidiary, Aloha Petroleum, at a high price. Who bought Aloha? A group of Harken insiders, who got most of the money for the purchase by borrowing from Harken itself. Eventually the Securities and Exchange Commission ruled that this was a phony transaction, and forced the company to restate its 1989 earnings.

But long before that ruling — though only a few weeks before bad news that could not be concealed caused Harken's shares to tumble — Mr. Bush sold off two-thirds of his stake, for $848,000. Just for the record, that's about four times bigger than the sale that has Martha Stewart in hot water. Oddly, though the law requires prompt disclosure of insider sales, he neglected to inform the S.E.C. about this transaction until 34 weeks had passed. An internal S.E.C. memorandum concluded that he had broken the law, but no charges were filed. This, everyone insists, had nothing to do with the fact that his father was president.

Given this history — and an equally interesting history involving Dick Cheney's tenure as C.E.O. of Halliburton — you could say that this administration is uniquely well qualified to chase after corporate evildoers. After all, Mr. Bush and Mr. Cheney have firsthand experience of the subject.

And if some cynic should suggest that Mr. Bush's new anger over corporate fraud is less than sincere, I know how his spokesmen will react. They'll be outraged.

Glad you posted that tidbit about the CLINTON SEC closing the investigation. I was just about to. If Clinton had found anything to go after GW about, they certainly would have done it. The media and the RATS KNOW this is bogus but that won't stop them. And it won't stop the DU infiltrators on FR, either. The word "disgusting" does not begin to describe my feelings on this issue. And the media plans to run bigtime with this story - the facts will not get in their way. It's a Republican President and that's all that matters to them.

This is going to fade away because there is no substance to it. It's a smear, but it's not true. Bush-haters like Pitchfork don't care about the facts, but in the end, the truth matters and will win out.

In the meantime, these folks are proving themselves to be liars and idiots.

Sounds like Krugman has an agenda against the present prez and not the prior prez...it's all one club as is becoming more and more evident everyday.

G W Bush did file the appropriate form with the SEC prior to selling his stock. What did not get filed was a second form that is to be submited after the sale. There is debate about who was responsible for this ommission; Bush or the corporate attorneys.

The sad part about this is that plenty of people will believe it because they don't bother to get the truth. The media and the RATS (same difference!) figure they can take the President's popularity down a few points at a time. The RATS, unlike the Republicans, are very, very patient. It's too bad the most Rightist of us don't realize the consequences of NOT voting for all the Republicans they can. They whine about liberal justices but will not help GW get a Republican Senate. Such hypocrisy turns my stomach.

I don't recall the Clinton SEC investigating the cattle futures, and I'm not sure why they would have. The transaction itself was not suspect.

Maybe you can fill us in on the details of that investigation.

Yes, people do develop emotional linkages which preclude the light of fact, reason, reality chasing away the cockroaches of wrong beliefs. Islamicists, Nazis, Trotzkyites, Maoists...history is replete with examples. Twas ever thus.

Like many Freepers, after much education and many years of observation, I KNOW that the Clintons are scum. This is as sure as gravity and predicated on exhaustively researched FACTS. Since that pattern of fact is real and inalterable, the remaining liberal defenders of the Clintons fall in two groups: The deceived and the deliberate deceivers. Krugman is still portraying them positively. He is therefore suspect. His NYT piece is compromised by the usual leftist selective reporting.

Is the response of a writer to the Clintons then a litmus test? You bet.

Is your implication that Bush is no better than his predecessor? This is demonstrably false. While many of us would prefer a rigorous Constitutionalist President, the hand we have been dealt is politically in a different galaxy from Clinton/Gore. The latter would have fit in nicely at the Leningrad State University of the 1970's when I was there. What would Gore have done with Kyoto, the ICC, the Taliban, and most critically...court appointments?

Yes, I am dismayed by the Trent Lottism of the Pubbies in the District of Corruption, but I am still grateful for Bush. We serve ourselves poorly not to focus on the opposition: Liberals of every stripe. Keep attacking Bush and get Bubbette Rex.

Krugman is not just a 'squishy liberal.' He is a liar and an enemy of freedom. Both deceived and a deceiver.

We're not on the Clinton Criminality on this one, so I'd say you can refresh your own memory on the matter. Try some searches using "Red Bone" in the string of terms, but then I believe you knew that.

Since Bush is Clean on the Harken Deal, right?, then Clinton(s)is clean on the Whitewater Deal, right? (no charges filed in either against them) Then why did Ken Starr drag that up? Or are massive amounts of evidence of wrongdoing only to be applied against "the other party"?

I mean the ones that will not vote for President Bush or Republicans that they don't consider "conservative" enough - but they have no problem with helping to elect RATS that will produce all the things they claim to fear most.

There's a wide majority that want our southern border secured and immigration controlled. But there is no acknowledgement by this administration of that.

Conservatives wanted Fiscal Restrain and Reductions in government largesse, this Administration ignored that.

Seems like Democrat policies to many of us.
