Surely you jest. In the first place the clause you quoted is in Section 10, not Section 9. In the second place these are actions forbidden to the states and not the Federal Government. I suppose that this means that Georgia couldn't enter into a treaty with the United Nations but has absolutely nothing to do with the United States. The treaty we have with the UN was ratified by the Senate, as required by Article II, Section 2, so all constitutional requirements were met.

New had two options for his defense: he could show that he actually DID obey the order, or he could show that the order was not a lawful order. He did not attempt the former; he was singularly unsuccessful in the latter.
New disobeyed a lawful order, received a fair trial (courts-martial actually give more protections to the accused than civilian courts), was convicted, and the convictions were upheld on review. End of story.

The UN flag was an unauthorized patch in an unauthorized place. The Army and Congress didn't have the courage to amend the regs and lacked the moral integrity to admit that they were wrong.
If soldiers are expected to refuse illegal orders, then it is incumbent on the Army to let the soldiers know which illegal orders are 'really illegal'. /sarcasm.
BWT, I wore the uniform and can only speculate as to whether I'd have the guts to stand up for what was right like New did. The easy thing is to go along to get along, but he didn't do it.

Colonel William R. Higgins, USMC, a patriot for sure. Our government has done some stupid things. First and foremost is getting us involved with the UN.
You have misinterpreted my post I would not slur Col. Higgins for his service I would however question those who control the UN and send American military people into harms way.
By the way will the US every get out of the UN police action in Korea? How many lives, how much of our treasury has that debacle cost America?
