The 9th has the WORST record of being overturned. Oh, I am quite aware of that. No other federal circuit comes close.
As a lawyer I would not hesitate to cite the 9th Circuit in a legal brief for the opposite of what they said. For example, if 7 Circuits held a first position on a particular issue, and the 9th circuit held an opposing view, I would argue to the Supreme Court that the first position MUST be right as the 9th Circuit said the opposite.

It may be overturned all right but the anti-Godders are going to get something out of it, because the overturning court will have to officially opine that the "God" of the pledge is as meaningless as the "God" of the "In God We Trust" on our money.
What is next, overturning the slogan on our money and outlawing the third verse of the Star Spangled Banner?

This decision will have the half-life of a "W" key in the Clinton White House. While temporarily discouraging, the Supremes will reverse without pomp or ceremony, probably 8 to 1. The biggest beneficiary will be the President and his judicial nominees. We've been waiting for a crack-pot decision to come down and force the Dems in the Senate to run for cover. The Ninth Circuit gave us this decision on a silver platter. Strict constructionists just came back into style today.
