Red Skelton foresaw this in his widely circulated explanation of the Pledge. It's just too bad to see his hope dashed (for now, until SCOTUS overturns this garbage). Actually, I think the vote will be 6-3.

IF it goes to the Supreme Court, it won't be for quite a while. It was remanded. Which means the District Court and the 9th Circuit both get another shot at it. Not to mention en banc review in the 9th Circuit.
