On the 30th day they CHARGED his as an unlawful combatant and transferred his custody and control from the DOJ to the DOD. There only remains the question as to the trial venue.Where did you get this information from? As far as I know, Padilla has not been charged with a crime. Last I heard was this:

The threat to liberty and freedom comes from Washington not Afghanistan. It's not Osama that denies an American citizen due process in this country. It's not the Taliban that allows law enforcement to break in and search your house and papers without a search warrant with no prior evidence of criminal activity. It's not Saddam that requires you to jump through hoops and do flips in order to own a firearm for self defense.

A few nights ago, Alan Keyes was ranting about poor ol' Padilla.. and he kept talking about how Padilla's gonna just disappear down some hole and never be heard from again.. and I was thinking exactly what you just said.. if this was done Lat-Am shtyle, he would have just "disappeared," period. None of us would be talking about him.

Yes. Look at both the sedition laws and citizenship revocation statutes. He is charged as an unlawful combatant just as those held at GITMO. His trial will establish his guilt or innocence of those charges.
