TOW TRUCK DRIVER CLAIMS HE HEARD WESTERFIELD TALKING TO SOMEONE!!!

Phone Records, Witnesses Trace Westerfield's Movements

Witnesses On Day 7 Show Movements

POSTED: 12:56 p.m. PDT June 13, 2002
UPDATED: 2:41 p.m. PDT June 13, 2002

SAN DIEGO -- The prosecution in the David Westerfield murder trial called on a cell phone company employee and several campers Thursday to verify the defendant's whereabouts the weekend Danielle van Dam disappeared.

A series of calls from Westerfield's cell phone in early February appeared to mirror his rambling motor home trip to the beaches of southern San Diego County and the Imperial Valley deserts, Verizon Wireless representative Greg Sheets testified.

But on cross-examination, Westerfield's defense attorney, Steven Feldman, sought to show that the cell phone calls were not a reliable record of Westerfield's locations that weekend. Under questioning by Feldman, Sheets admitted that the records don't give precise locations and don't identify the user of the phone.

Westerfield is charged with kidnapping and murdering Danielle. He could face the death penalty if he's convicted.

The prosecution also called a series of witnesses who were at Silver Strand State Beach on Saturday, Feb. 2. Westerfield said he drove his motor home to Silver Strand that morning.

Beverly Jean Askey of El Cajon testified that her family was already at the beach when a motor home that she later learned was Westerfield's pulled into a nearby space sometime before 10 a.m. It was a nice, sunny day she said, yet no one came out of the vehicle.

"He just pulled up, he pulled the front window closed and I never saw anyone again," Askey said.

Two other campers said they saw Westerfield's motor home and noticed that it appeared closed up.

Earlier, Angela Elkus, a resident of the Sabre Springs neighborhood where the van Dams and Westerfield lived, answered questions about the motor home. She said she had seen children playing around the vehicle three or four times when it was parked on the street, but she said they were mostly older children. She also talked about a visit to the van Dam home after Danielle disappeared.

Elkus said she had never been to the home before, but she brought food over for the family on the Sunday after the little girl disappeared. She said that the family's dog appeared "scared, shy, confused and perfectly still" when she came in the house, and it did not bark, she said. Legal analysts say prosecutors want to convince the jury that a stranger could have come into the house and taken Danielle without the dog barking.

Number 1: Don't waste your time arguing with cyn...usual source is her memory.

Well, my usual source (and it was in this case) is my memory.

In the meantime, I think all the info has come out on this, What the ramps were, why he didn't bother with taking them, why he wouldn't care if he lost them. There still is probably some varied opinion on it's importance to the case, but we pretty much have straightened this out.

Cyncooper has kept me on my toes. So have others. I don't mind. Rather have someone correct me, if I'm wrong, then be allowed to carry on with the wrong info.

No, wasn't suggesting anything of the kind. I've heard the testimony about her too. Now, I'd like to hear the testimony from her. At least, I think I would. OTOH, maybe I'm not old enough to hear anymore than I've already heard about her. ;)

Rheo - Thank you for your real-time running commentary. It's great for those of us who can't watch/listen to the trial.

MizSterious - I'm happy to see you back...missed your commentary!

They showed them in court, the same day they showed the closet pictures. Wasn't terribly impressed with Brenda's housekeeping skills. OTOH, David, can come clean my house. OMG, that place is immaculate, you can tell no kids live there.

maybe I'm not old enough to hear anymore LOL

Me neither, and I'm retired.

It's interesting to me that the Prosecution's case so far has verified just about everything DW has said, while giving the jury TWO viable alternate perps, Damon and Barbie.

Sorry, Didn't mean to let answering you go so long.

Is DW in custody, or released on his own recogs? We don't get any reports about what an "over-cooperative" prisoner he is.

You know, I never heard that bail was set or paid,or whether he was in custody. I believe, from the looks of things, that he is not in custody. The court probably did a released on his own recogs , but the media didn't want to let that out as it makes it look like he is not the BIG SEXUAL MOLESTOR/MURDERER the press wants him to be.

I thought there was no bail in death sentence cases. I think he's housed......and hosed.

I think there were some hallway photos somewhere. Looking from the end toward the master BR. I do recall seeing a bookcase either across from Danielles room or between doorways. Also BVD mentioned the vacuum sitting in the hall because she was going to use it upstairs.

I hadn't listened to him prior to this trial starting but I turn him off now at breaks..is he watching the same trial as I?

RR and the COURT TV reporters are in the same boat, if you ask me. So, the answer to your question, "is he watching the same trial as I? ", is NO. They aren't watching it at all. They are too busy with makeup, scripts, following teleprompter, being told about next guest, etc. to actually watch the trial.

They are (especially CTV reporters) being told what to say, reading from prompts. It's about like doing the news by reading headlines from the National Enquirer.

He should have known. I don't remember the cone of silence ever working, even once. And I've seen every episode of Get Smart ever made.

Actually, just housing him separately from the general population has costly for SD County.
