To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water

"No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay."

A state of war can exist without a Congressional declaration. Further, our President is acting with the full knowledge of Congress, and its consent.

Where does the Constitution require a formal declaration of war to for our military to capture and hold "Citizens of the United States who associate themselves with the military arm of an enemy government, and with its aid, guidance and direction enter this country bent on hostile acts..."?

By "probable intel" I meant intelligence that probably might be learned. Sometimes I use my own "shorthand" by mistake, my apologies. :) And by "securing other terrorists from gaining the knowledge of his detainment" I was refering to his detainment since May 8th. They held him for over a month with no public knowledge of his detainment. I suspect that Ashcroft made the announcement because he was transfered into military custody. Time should bear out the complete details.
