Maybe he was arrested before he set foot on American soil. The two FBI agents who arrested him flew back from Switzerland to Chicago on the same flight with Jose'. He may have been arrested at O'Hare or he may have been arrested as soon as they cleared European airspace.

No they allowed him to clear the custom zone. I think they figured they had him anyway.
