Padilla was an insider, and it's apparent the web around him must be pretty tight. DOJ wants to avoid discovery here, as they do in Moussaoui.

Wrong! Moussaoui has been charged. This guy has not. We have a set of laws, a Constitution. If this guy is a serious National Security Threat then the US Attorney would have gotten him charged as one.

What happens if this later comes to light as nothing more than a intelligence source blowing smoke. Does Richard Jewel mean anything to you?

The US Attorney had a threshold low enough to get a ham and cheese sandwich charged. Why not here?

I agree but I think it was a mistake to give JJ the criminal venue. Military tribunal then about 20 at Leavenworth. He'd still be a rather young man upon release.

Execution or life if proven he helped to kill Spann.
