Wouldn't 'activist' mean non-constitutional?

I would call a "non-constitutional" decision of the Supreme Court (to the extent that that is not by definition an internal contradiction) to be an erroneous decision. An "activist" decision is typically a label applied to a decision in which the Supreme Court concludes that a legislative body (state of federal) has exceeded its constitutional powers.
