Kim have you ever smelled pot? If nothing else that would be obvious to the kids..Kids look and see alot..they listen at doors , they are curious..Trust me they may not have put two and two together..but they were close. The VD's were not careful to hide their behavior ....note that Barb was in moms bed kissing dad. One of the kids could have walked in any time..and my guess is that is not the first time that happened..Damon said that the adults there all knew the house .Kim they had all been upstairs for sex IMHO.....and the kids would have hear as the swingers ads say the sounds of lovemaking

Thanks for this post amore..I missed it..I figured you had missed my question..and then I had forgotten about it.

To: ~Kim4VRWC's~ Kim, someone raised this yesterday, indicating that those of us on the prosecution side were ducking this question. I wasn't ducking, I didn't feel qualified to answer it. But it's true that if there was evidence that DW was in the home, it would have to have been provided to Feldman. So I doubt Feldman lied and I doubt there was a discovery violation by the state on this issue. That indicates there isn't any.

Now, instead of immediately concluding that means DW didn't do it, I'd like to hear someone from a scientific background explain to us whether that's feasible. Certainly, in the olden days, it was very feasible. Less so, with DNA & fiber analysis today, but it seems certainly possible to me with what I know from watching true crime shows all the time that he could walk in and out quickly without leaving anything to tie himself to the place. Especially in light of the swinger traffic in and out of the house and if Damon is telling the truth that he didn't do any cleaning, then there would be lots of fiber evidence for instance but it wouldn't necessarily be traceable back to DW. If the VD's choose to be swingers and attend swingers clubs, or have swinging parties where children were NOT around, then I would say it should have no consideration and I would not be talking about it.

BUT THAT IS NOT WHAT THEY DID. They chose to have the swinging at home, in hearing/view of the kids. They chose to do what are illegal drug(s) where their children could detect that they were. They chose to invite not just married couples to swap with, but singles. They chose not just people they knew/trusted, but total strangers. That is why their choice of lifestyle and whether it was a contributing factor in the loss of their child!

I agree. Little pitchers have big ears. This swinging appears to be no small part of the VD's home picture. Thinking the kids were blissfully unaware of it all is naive.

When Feldman was asking PDvD as to his withholding(lying) to the LE about what went on that night in their house. PDvD answered this way: " I didn't think it mattered." he said.(end snip) Very softly under his breath, PDVD said," I still don't." That hasn't been reported as far as I can find but I heard PDvD say it. If someone has the testimony taped would they look at that part of the testimony and see if that statement is there? In case I am wrong.

Another snip from the above article: Van Dam said he and Brenda "got very nervous very quickly "when they discovered Danielle missing the morning of Feb.2." (eos.)

Think about that statement for a second.......PDvD went on to say during his testimony that as soon as he realized something very bad had happened he stopped lying to the LE and cooperated with the police.(or similar words) I believe the cooperation with LE begin something like 14 hours after finding Danielle missing.

So far, still no evidence that DW was involved. Just alot of chatter about the child being dead.

And--should you ever be approached by a policeman for any reason, don't cooperate: lawyer up. Otherwise, you're obviously guilty of something. But I will also point to those 6 interviews as supporting my point. Notwithstanding what may have been the usual police disinformation to the contrary (saying, oh, no, we don't suspect the parents when in fact they absolutely do) this to me says that the police did work HARD to get at the truth of what happened. They investigated the parents thoroughly and finally ruled them out. And police do parallel investigations. They don't investigate suspects sequentially. I believe they were investigating DW, the parents, and their swinger friends simultaneously. The evidence led away from the parents and straight to DW.
