JUDICIAL WATCH UNCOVERS FORMER INS COMMISSIONER MEISSNER’S ORDERS TO DESTROY EVIDENCE IN DECISION TO RETURN ELIAN GONZALEZ TO CUBA AND SUBSEQUENT, ILLEGAL RAID ON GONZALEZ FAMILY HOME

(Washington DC / Miami) Judicial Watch, the public interest law firm that investigates and prosecutes government corruption, announced that tomorrow, April 10, 2002, it will release documents revealing former Immigration and Naturalization Service (“INS”) Commissioner Doris Meissner’s orders to destroy evidence and obstruct justice in the illegal raid that returned Elian Gonzalez to Communist Cuba that resulted in the beating and gassing of dozens of peaceful protestors by INS agents. The documents were produced for the first time today in a trial before the Merit Systems Protection Board (“MSPB”), in Miami, concerning charges of retaliation against INS Special Agent Rick Ramirez, by his supervisors in the Miami District Office of the INS. An INS attorney, Diana Alvarez, produced the documents during sworn testimony in the hearing. Ramirez is an INS whistleblower who initially revealed the INS and Justice Department obstruction of justice and anti-Hispanic prejudice that pervaded the Elian Gonzalez saga.

The documents reveal that the U.S. government had information indicating that Juan Miguel Gonzalez (Elian’s father) had sought to leave Cuba for the United States. They also reveals the U.S. government was aware that Juan Miguel wanted Elian to stay in the U.S. and that the father was being coerced by the Castro regime.

INS attorney Rebeca Sanchez-Roig notes that she was ordered to destroy all documents, but retained a copy of the e-mail because she believed Meissner’s destruction orders to be improper.

Copies of the documents will be made available at the press conference.

Obviously not all of the original email copies were destroyed, or perhaps the copy given to JW 2 years ago was the Sanchez-Roig copy that had been deliberatly altered in order to hide the handwritten note, eh?

Sanchez-Roig indicated that the tele-conference wasn't 'confidential in service', that other govt depts were involved (State), but the article said that the INS gave the copy to JW 2 years ago.

In any case, the memo didn't include an "allegation in the handwritten part that all copies were destroyed ", it said quite clearly that at least 1 wasn't. The allegation was that Sanchez-Roig was instructed to destroy all copies.

Interesting point. The idea that someone wanted to keep things quite about this, (i.e. a coverup) would be made even tougher in that the author of the memo wasn't even certain who the attendee's were. For all they knew a member of the press could have been listening in. That would make an order to destroy the memo even more perplexing.

THe implication by JW was this was evidence that was deliberately withheld. The fact JW had a copy of the memo without the handwritten parts indicates that despite the author being told to destroy all copies some one in charge kept a copy to turn over. The concept that a cover up was being implemented makes no sense seeing that there were multiple participants on the phone line and seeing that all copies were not destroyed.

It may have been deliberately withheld, if indeed the INS had a copy of Sanchez-Roig's ammended copy. That being said, nothing in the memo, including the hand written part, would have been particularly helpful to Elian's case. Nothing in it would impress an appelate judge.

I would love to hire a lawyer who knowingly fights losing battles. If I was seriously wronged, or had my reputation slandered such as Linda Tripp and Notra Trulock had, I would be glad to hire a lawyer like Larry Klayman. You know why? Because it is much easier to complain and stand on the sidelines, rather than actually doing something about the things that we see horribly wrong in this world. People at one time believed that an independent America, free from the control of Great Britian, was a lost cause also. But there were still many Americans who had the ability to dream and fight for a cause greater than themselves, that believed otherwise.

I would hate to live in an America without people like Larry Klayman and the staff of Judicial Watch. An America absent of the kind of people who fight for a cause greater than themselves, who refuse to believe that there is a higher standard of ethics and morality that America can live up to, is an America that I cannot even imagine existing, mainly because this would not be the type of country our Founders had envisioned when sacrificing their lives for a cause greater than themselves.

Judicial Watch is unapologetically conservative and they seem to understand what many people have forgotten--that human nature is flawed. Even the most well-intentioned government can become corrupt and demagogic at times if not properly checked and tempered--Judicial Watch successfully does this by being a government watchdog organization. We need people like them around, especially when there is an overabundance of complacent, detrimentally partisan, and apathetic people around. Edmund Burke once wisely stated, "All that is necessary for the triumph of evil is that good men do nothing." Well, at least Judicial Watch is doing something, which is a whole lot more than their detractors have ever done.

You need to have more patience with Klayman and Judicial Watch. They are working on many cases and the wheels of Justice do not turn fast, especially with an uncooperative Administration and Justice Department.

Don't think so. Klayman is a self-serving clown. Check out his balance sheet. I put him in the same class as Jessie (the extortionist) Jackson. At least Jesse has some impact (all negative).
