One of the neighbor's gardener disputes the "casual" relationship between BvD and DW. What is it with men and cheap bleached blondes? Sheesh.

Personally, I can't imagine anything worse than losing a child. I also know I'd be telling the truth and nothing but the truth to make sure the person accused pays.

He asked to meet her friends. Seems like she was the spurned one. Jealous of Barb for more than one reason.

This is important to note..
http://www.law.nyu.edu/foxe/fall01/torts/slides/torts_negligence092101.pdf THE NEGLIGENCE ISSUE DUTY BREACH CAUSATION- The reasonable person does not normally expose others to unreasonable risks therefore (?) what a reasonable person does is not negligent; we tolerate this conduct even if, by accident, it causes harm But who is the reasonable person? By what gauge do we measure?
Joe Citizen public tolerates dancing in public, infidelity, swinging, beer, liquor and bars. Joe Citizen sometimes tolerate pot, but the law we create does not in most instances. Joe Citizen tolerates bongs sold in certain kinds of stores that minors have access to just because. Joe Citizen tolerates speaking to neighbors in public. Joe Citizen tolerate ''sex games'' because we don't enforce antiquated sex laws. We tolerate our civil liberties and freedom because we do not dictatorship, and tyranny.

Of course they had no clue to where he could have gone!
That is what APB's ARE FOR! To find a suspect, when you have no clue to where they could be.
Look, on Saturday and Sunday, they were actively searching for a kidnap victim that could still be alive, with massive manpower and resources. If they had information about DW making him a suspect before the Monday interview, there would have been an APB, a little girl's life was at stake. I don't care how dumb, biased or incompetent you think SDPD is. They would have gone after him earlier if he had been a suspect earlier.
Given the aggression they showed toward DW after the Monday interview, where was that same aggression before the interview if he was a suspect before THAT interview?

I respect your position. I am not chastising the VD's for their lifestyle, only examining it for their credibility, possible involvement and any possible motive and opportunity they or their circle of friends had.
I am also looking at how they appear in public as that is part of the above.
If I recall right you are from the San Diego area, what do you think of the allegations of the Police Officers Conduct? You can read more at the links I gave in my recent posts. sincerely..rs

I would think they could easily fax her, depose her..but beings she's overseas..I'm not sure if she can actually get a notary.

You know maybe, just maybe SDPD was just a little ticked off because they had to wait for DW. A full 48 (okay 46)hours they had to wait on David Westerfield to return. I shudder to think what they would have done had he not showed up until Tuesday. Gotten out the bright light and rubber hose?
They were pointed in his direction. The motion addresses that. Actually the PH addressed that. But whatever, Bren and her sweetie are hiding alot.

...Bump that.. the agression was directed towards all the rest of the neighbors, people in the vd house that day etc..

I don't see how they could be ticked off..they just moved him to the last on their list of 180+ neighbors. How long could that possibly take?

Reasonable person in my opinion is what society considers to be the mean norm. Laws are created based on what societies accept as norm.
I don't accept drinking, drugging, bumping, grinding, swapping, lying, cheating, leave your kids alone parents to be the norm. Do you?

I think that when there's no defense, the police are blamed. It's the oldest story in the book.

Actually, you don't know what you would do in a similar situation. That's my point. NOBODY knows how they would act, that is why we can't judge. And believe me, I'm a HUGE judger!

I don't accept drinking, drugging, bumping, grinding, swapping, lying, cheating, leave your kids alone parents to be the norm. Do you? Excellent questions. A judge would say that there are no laws against all of that..some have restrictions. For example, one 12 year old kid can be left alone..and another 12 year old kid can't. It depends on the level of maturity and would only be decided on a case by case basis. If all the events you describe contributed towards the OBVIOUS neglect of a child..then teh parents would be charged with negligence, but not drinking etc.. If the neglect isn't obvious, that is what family court is for. Investigating, charging parents, foster homes etc..

According to the PH 13 hours.

I'm not sure I made myself clear. Did it take the investigators 13 hrs to interview all of those neighbors? I honestly can't imagine them getting mad cuz a neighbor isn't available..for a weekend. Im sure they had plenty of stuff to keep the occupied.
