I absolutely agree... I really doubt the Founding Fathers intended for the free speech right to be used to protect someone running around town saying such garbage. In fact... I bet in 1789 that somebody saying something like this would have just been shot in the street and depending on how offended the rest of the crowd was he may or may not have gone to jail.

I don't think the founding fathers needed to worry.

If someone had have done this, they would have been hung , drawn, and quartered.

By protecting these idiots from the "mob", we add emphasis to the nanny state.

Seat belt laws, drink driving laws, speeding laws, smoking laws.

When are people going to revert back to being responsible for their own actions?

You're probably right. The 1st Amendment establishes a restriction on Congress, not on any other level of government. Those who would argue that the 14th amendment "made the Bill of Rights apply to the states" need to take notice that there is no mention of that in the text of the 14th. The 1st is unaffected by the 14th. It still applies to Congress alone, the extensionist absurdities of jumped up lawyers on federal benches notwithstanding.
