I tend to agree - this speech should have been protected. I'm not a Constitutional lawyer but it seems to me, IMHO, that applauding and actually encouraging more acts of war against the United States of America meets the U.S. Constitution's definition of treason in "giving aid and comfort to the enemy".

What about the accessory to murder angle? If you are running around saying such things and you incite a person to kill more Americans, are you not an accessory to murder? In this case since nobody did what he said, I would charge him with conspiracy to attempt murder or terrorism.
