Its not up to GW to decide if a Bill is uncontitutional

I think you should look into some reading on the government and the roles of the branches. It is absolutely the duty of the president to decide if a bill is unconstitutional. The executive branch makes decisions about the constitutionality and/or unconstitutionality of laws all the time.

Americans don't acknowledge the authority to adjudicate of the executive and legislative branches.
