When the parents asked school officials why the school district had not complied with their opt-out requests, school officials said many of the forms were "missing," according to court documents.

Uh huh..."missing." Like many legal documents at Enron and Arthur Andersen turned up "missing."

That shouldn't stand up in court. It may, if the wrong judge is hearing it.

Although we homeschool, our older two went to public high school. We thought we were doing ok by having them take health (translation: sex ed) by correspondence where the kids wouldn't have to sit through the usual garbage of who's having sex in the backseat. Well, their biology book had a chapter on the birds and the bees. Fine. Not so fine was the lengthy discussion on birth control. Even had pictures of various birth control items. I created such a fuss that the teacher had to skip the entire chapter. :) She, the principal and the assistant principal were warned that we had submitted letters that our daughters were NOT to participate in ANY discussions of sex or birth control, that it was our right, and that we would sue. We were very polite about it, too.

Funny thing was, other parents were bothered, too. Their kids were taking health by correspondence, too. They wouldn't speak up, though, because they were embarrassed. If they couldn't stand up to a little peer pressure, how do they expect their kids to do the same?
