Alabama Chief Justice Calls Homosexuality 'Evil' In High Court Decision

MONTGOMERY, Ala. - In awarding custody of three teenagers to their father instead of their gay mother, Alabama's chief justice on Friday wrote that homosexuality is "an inherent evil" that should not be tolerated.

The nine-judge Alabama Supreme Court ruled unanimously in favor of a Birmingham man and against his ex-wife, who now lives with her gay partner in southern California.

The parents weren't named in court documents to protect the identity of the children, ages 15, 17 and 18.

Chief Justice Roy Moore wrote that the mother's relationship made her an unfit parent and that homosexuality is "abhorrent, immoral, detestable, a crime against nature, and a violation of the laws of nature."

Moore also quoted scripture, historical documents and previous state court rulings that he said backed his view.

Moore is known for his decision to place washing machine-sized monuments of the Ten Commandments in the state judicial building after he became chief justice last year. He earlier became known nationally as the "Ten Commandments judge" when he fought to keep a plaque of the Biblical commandments in his courtroom as a district judge.

David White, state coordinator for the Gay and Lesbian Alliance of Alabama, said Moore's opinion reflected outdated thinking.

"It's unfortunate Alabama is going to be embarrassed once again by a religious fanatic in a position of power in Alabama," White said. "It's obvious he cannot judge a gay person fairly and he should be removed from office."

John Giles, state president of the Christian Coalition, said Moore's decision protected the institution of marriage and strengthened the traditional family.

The father had held custody since 1996, but the mother petitioned for custody in June 2000, contending the father had been abusive.

John Durward, the father's attorney, said his client "is very relieved." The mother's attorney, Wendy Crew, did not return a telephone call seeking comment.

When in every newsroom of the country you have a "gay" agenda and reporting faction do you really think that this issue will be discussed honestly?

How has the issue been treated so far? I have seen "Dateline" reports with happy children being reared by white middle class gay parents or parent- taking them to little league and dance class- then they show, for "balance", some bible thumper religious nut (usually ugly or unattractive) saying it is wrong in dumb ass terms. Seem familiar? It is - becasue that is how AIDS victims were presented to us throughout the entire epirdemic at it's height and even today. Ryan White? Remember him- the poster boy for aids- desingned by the mass media as the face of AIDS?

The dishonsty behind gay issues in this country and how they are presented are so legion that I can't believe you actually think an honest discusssion is even possible in our mass media?

Maybe you should revert to finding some hard data. This touchie feelie stuff is getting old. If gay parents suck as it were based on the data, then your position will prevail, at least in most places. If you just think putting aside the issue of whether or not the children of gays are as successful as other children, that you just dislike it aesthetically, or on religious grounds, or as against nature, or because your intuition tells you the data must be false due to certain hard wiring a priori assumptions, then you will lose, in most places, eventually. See how it works in the greatest nation on God's Green Earth?

Ok- on what should law be based if not concepts of "evil" or right or wrong? Who decides? Should only "enlightened" people- above such concepts decide what should be law or be judges?

All law is based on concepts of evil and good- right and wrong. Even atheists base there law on their notion of right and wrong as did Stalin and Hitler- niether of whom believed in a God. News for you- our legal system is based in Christian legal jurisprudence. Get used to it.

This is just dying for an overturn by the US Supreme Court because of his language.

If he'd stuck to the law there'd be no risk of that. But he has to make it too easy for the federal courts to intervene.

Ah, the true colors come out. I figured it was a matter of time. I recognize your "if it's not in the Rt. 128 loop, it's not worthy" attitude. I just wish some of your fellow carpet baggers felt the same way. We would be much better off without them and their politics.

I've lived in New England and in the South and you couldn't be farther from the truth regarding the "conservative" side of Massachusetts or the "good people are in Mass" side. They don't call you all Massholes for nothing you know. Keep pretending you're not in a socialist paradise (what's the minimum wage, state and property taxes like up there in conservative local Mass?) afterall, Ignorance is Bliss.

NO- I am confidant that common sense will rule. The same common sense that says that if a man or a woman leaves his wife or husband and children to have sex with another man (or more typically multiple men) or a woman - pretty much indicates that he or she is not fit to raise children. That and the suicide, drug addicition, alcholism, mental health problems, and overall much lower life expectancy, that seems to accompany the "Gay" lifestyle. Oh- but we can't talk about that- can we?

I remember a New York Times headline about 5 years ago- "New Study Finds Divorce has Detrimental effects on Children"- or to that effect. Gee- tell me something I and you and everyone didn't know from common everyday experience.

I know that, you know that, and Roy Moore knows that. It's what he wants. Politically, it's what he needs. He's a politician first and last. All the other crap about him is just window dressing, and I pray, yes pray on my knees, for all the people who have bought into his line of B.S.

Just one other thing. For all the conservative talk about the South as compared to the North- I just read somewhere that the Bible belt has a bigger divorce rate than New England? And from personal experience- I can say that the South talks a big game about morality but actually lives quite the opposite.
