You know, of course, that these people have papers. And, unfortunately, restaurant managers aren't expert forgery detectors. They may be good, but they're not experts. And I believe the law doesn't have the expectation that they be so. Also, the managers can be accused of discrimination if they try to avoid hiring "documented" immigrants. So how'd you like to be the prosecutor on that case?

All good poiints... We don't want to destroy employers who acted in good faith on the basis of fraudulent documents. But good faith defenses protect merchants against prosecustion aginst fraudulent or forged IDs used for liquor purchases. We could provide the same safeguards for honest employers.

Guest Worker smart ID cards would help.

I'd love to be. I have watched illegals fill out papers from other illegals. I have seen some of the "forgeries". They are junk and VERY easy to spot. Documented workers can also be checked on. A simple phone call is all that it takes. How many "Manuel Artegas" work in Denver? 1,000? It seems one gets in legally and gives the ID to 1,000 others.

Besides all that, if the person cannot speak a lick of english, why are these McDonalds' putting them on the registers trying to take orders?
