Maybe to clarify, THEY TOOK THE FEE, but provided NO SERVICE. And now they are petitioning their customer base to see if they can bilk them out of more money!
It's fraud -- if and only if -- they knew they had no intention of providing the service. I'm not sure if you have enough evidence to draw that conclusion yet.

You haven't been following the story, it's obvious from the statement above. Photopoint has gone WEEKS AND WEEKS without informing their customers what is going on with their company and the photos that people entrusted them with, and PAID them to store. What does it take to send a bulk email that they were trying to get back on their feet? What does it take to tell people that you still care and want their business. Not much in these days of electronic communication. They have been mute to people's calls and emails. They are shysters. Article after article has been written about their unresponsiveness to customer requests on a status of their business. That to me is ample evidence.
