First of all there is the peculiar positioning of the junkie. I noticed that you placed the junkie in the street and not on your front lawn.

Can you tell me why you did that?

To put you in a quandry. Who is the bigger criminal in your eyes, the junkie shooting up in the middle of the street(not bothering anybody while shooting up) or the neighbor across the street who calls the police complaining about a public nuisance?

Would you automatically brand your neighbor a constitution hating statist?

This entire line of reasoning could be labeled pointless, as most Americans have long accepted laws against public substance consumption (aka open container). Whether or not shooting up heroin in the street should be illegal has nothing to do with legalizing marijuana. I think it would be reasonable to expect the same types of controls to apply to legalized drugs as apply to our legal drugs today.

No you did it to avoid my other question. You put up another decoy. If the junkie is on your front lawn we have rights of property to consider.

So lets consider them.

If the junkie is in your yard, or in the street what would be the difference in your response? Would it be criminal for me to call the cops to tell them someone was shooting up on your lawn?

Now your question:

You are right, we have a quandry here. How can a junkie not bothering anyone be a public nuisance? Is he a nuisance because of his use of the street? If shooting up in the street is not a crime, just which nuisance law did he break?

No, I would not call the neighbor a constitution hating statist. Why would I care if he was? I my Libertarian world I would have laws to hold his political actions(initiatory force) in check. To the contrary, if I knew that the police would help this man far better than myself(because as a libertarian I would hope the police could to that), I would beat the neighbor to the phone and call the cops myself!

More quandry. Why as a Libertarian, would I do that?

Bonus question: Would it make a difference if the man was in your front yard doing the same thing?
