Does the fact the federal goverment have some scope to act outside of expressly delagated powers enable it to remove rights from states and individuals that would otherwise be retained by them? No.

And yet you think this enables the fedgov to write legislation banning a patently non-interstate and private activity as someone growing and smoking marijuana? And remember, it isn't whether this should be banned or not, it's whether it should be state or federal.
