I don't think Jacoby is suggesting this absolves Lindh from responsibility for what he did, and neither am I. If convicted of treason, he should be executed IMO.
OTOH if the evidence shows that the Al Qaeda had him drugged/brainwashed, that should be considered. Based on what we now know, it doesn't look like that's the case -- I think he voluntarily decided to fight against his country -- but all the evidence isn't in yet.
