I wonder what kind fo rights pre-historic man had before there ever was a society or government . . If you believe in those rights as God-given then they were always there. I didn't mean to say that our founders created our rights. They recognized those rights and wanted to protect us from government abusing them. So they put that protection into words.

So basically what you are saying is that, in fact, EVERYONE has the same inalienable rights. These were not rights given, but rather "are" by nature of being human. If this is the case, then because the Constitution does NOT grant rights, but rather protects natrual rights, then the Constitution applies to every man, woman, and child, regardless of citizenship. You cannot have it both ways my friend.
